Trademark and Content Policy
Product photos show brands, logos and packaging. This page explains who is responsible for them when you use ProduktShot, what you must not make, and how a rights holder can report misuse.
Last updated: September 25, 2026
1. Your Responsibility
1.1You alone are responsible for making sure that what you upload, make, download and publish with the Platform does not infringe trademarks, trade dress, design rights, copyright or other rights of others. This covers:
- the product photos and product pages you upload or import;
- the prompts, headlines and other text you give us;
- the images, posters and other results we make for you, and anything you make from them;
- how and where you use a result, commercially or not.
2. Your Own Brand and the Products You Sell
2.1You may use the Platform for your own brand and for genuine products you are allowed to sell. Showing a genuine product as it is, with its own packaging and label, is normally fine.
2.2Using another company's name or logo beyond that, for example in a headline, as a badge or in a way that suggests the brand made, sponsors or endorses your listing, needs that company's permission. Also check the rules of the marketplace or ad platform you publish on: many have their own brand rules.
3. No Trademark Rights Granted
3.1That the Platform can make an image showing a brand does not give you any right to use that brand. ProduktShot does not own the brands in your photos and cannot license them to you. Get permission from the owner before you use their marks commercially, make new material based on their brand, or suggest any link with them.
4. What You Must Not Make
4.1You agree not to use the Platform to:
- make counterfeit goods, fake logos, labels or packaging, or material for them;
- pretend to be a brand, a shop or a person, or suggest a partnership or endorsement that does not exist;
- mislead buyers about where a product comes from, what it is or what it can do;
- add seals, certificates, awards or quality marks the product does not hold;
- copy another shop's product photos or listings, or make near copies of them;
- make unauthorised branded merchandise or other grey-market goods.
4.2Breaking these rules also breaks our Terms and Conditions.
5. What We Check and What We Do Not
5.1Before an action runs, we check the request against our rules, and we may refuse it. We do not check whether content infringes trademarks: we keep no trademark database, do no clearance searches and give no opinion on whether a use is allowed. Trademark law differs from country to country; you are responsible for the law where you sell and publish.
6. Report Infringement or Illegal Content
6.1If you hold rights in a brand, or you believe content made or stored with the Platform is illegal, tell us through the contact page or at [email protected]. So we can act on it, your notice should include:
- your name and email address;
- which right is infringed (for example the trademark, its registration number and country) or why the content is illegal;
- where the content is: a link, an account or result identifier, or a clear description;
- a statement that you believe in good faith that the information in your notice is accurate and complete.
6.2We confirm that we received your notice, look at it promptly and carefully, and tell you what we decided. If we remove content or restrict an account, we tell the person affected why, and they can reply and ask us to review the decision.
7. Repeat Infringers
7.1We close the accounts of people who infringe others' rights again and again. Depending on how serious and how frequent the breaches are, we may warn, suspend or close an account, and refuse a new one.
8. Trademarks on Our Pages
8.1ProduktShot and its logo are ours. Names of marketplaces, platforms and other companies that appear on our pages, such as the marketplaces we give image rules for, belong to their owners. We use them only to describe what our tools work with; this does not mean they endorse or work with ProduktShot.
9. No Legal Advice
9.1This page is general information, not legal advice. For a question about a specific brand or use, ask a lawyer who knows intellectual property law.
10. Changes and Contact
10.1We may update this policy; the date of the last change is at the top of this page. Questions: write to us through the contact page or at [email protected].
